On Monday, a federal court in Kansas refused a preliminary injunction that would have enjoined Kansas House Bill 2106, a new law designed to prohibit foreign influence in state constitutional amendment elections. Kansans for Constitution Freedom, which accepted over $1.5 million in foreign money in the last state constitutional amendment election, challenged the state law and was backed by a prominent Democratic law firm, who has led similar efforts nationwide.
Our team represented Kansas Attorney General Kris Kobach and officials from the Kansas Governmental Ethics Commission. The plaintiff argued the law violated First and Fourteenth Amendment rights. The court disagreed—finding the statute likely survives strict scrutiny and does not violate constitutional protections.
