Client Win: Womble v. Chrisman

Client win: We are pleased to share another significant victory for our team and, more importantly, for our client Joseph Womble.

In a published decision, the U.S. Court of Appeals for the Tenth Circuit reversed the district court’s ruling on our Eighth Amendment claim challenging unconstitutional conditions at an Oklahoma state prison and remanded the case for trial. This marks the fourth time this case has been before the Tenth Circuit since 2017—and the fourth time we have prevailed.

Prison conditions litigation is among the most consequential work in public law. The people confined in these facilities are entitled to constitutional minimums, and when the state fails to meet those obligations, the courts must hold the line. This decision reaffirms that constitutional principle and ensures our client will have his day in court.

Julian Ellis and Brownstein Hyatt Farber Schreck represented Mr. Womble on appeal.
