At issue is Oregon’s law banning the recording of conversations without the consent of all parties—a statute the en banc Ninth Circuit upheld, despite its chilling effect on investigative journalism and public accountability.
Our amicus brief urges the Court to grant review and clarify how such laws intersect with core First Amendment protections, particularly in the context of newsgathering and undercover reporting. The case raises urgent questions on the boundaries of newsgatherers’ First Amendment rights in the digital age.
